AiPay Mart Terms of Use
This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name \[www.aipaymart.com\] (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”)
The Platform is owned by AiPay Technology Private Limited, a company incorporated under the Companies Act, 1956 with its registered office at A Block, Office 1, Khan Building, Nawab Tank Road Dockyard, Mumbai, 400010, Maharashtra, India (hereinafter referred to as “AiPay Mart”).
1. Definitions
1.1 Platform refers to the AiPay Mart website and associated services.
1.2 Vendor refers to any individual or entity listing products or services for sale on AiPay Mart.
1.3 Buyer refers to any individual or entity purchasing products or services from the Platform.
1.4 User collectively refers to both Vendors and Buyers.
2. User Eligibility
2.1 You must be at least 18 years of age to use our Platform. (Parents or Guardians guide shall be observed in case if the user is minor)
2.2 By registering, you represent and warrant that all information provided is accurate, truthful, and up-to-date.
3. Account Registration
3.1 Users must create an account to access certain features.
3.2 You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities under your account.
3.3 We reserve the right to suspend or terminate accounts for violations of these Terms.
4. Vendor Terms
4.1 Vendors must comply with all applicable laws and ensure that the products listed are genuine, safe, and legally permitted.
4.2 Vendors are solely responsible for accurately describing their products, setting prices, and fulfilling orders promptly.
4.3 AiPay Mart reserves the right to review, approve, or remove any product listings.
5. Buyer Terms
5.1 Buyers must ensure that all information provided during the purchase is accurate.
5.2 All purchases made through the Platform are subject to the respective Vendor’s policies, including shipping and returns.
5.3 Buyers should review product descriptions, terms, and conditions before making a purchase.
6. Payments and Fees
6.1 Payments are processed through third-party payment gateways. AiPay Mart is not liable for issues arising from the payment process.
6.2 Vendors agree to pay any applicable fees or commissions to AiPay Mart for using the Platform.
6.3 Prices on the Platform are determined by the Vendors and may include applicable taxes or charges.
7. Intellectual Property
7.1 All content, trademarks, logos, and intellectual property displayed on the Platform are owned by AiPay Technology Private Limited or licensed to us.
7.2 Users may not use, reproduce, or distribute our intellectual property without prior written consent.
8. Prohibited Activities
Users must not:
8.1 Violate any laws or third-party rights.
8.2 Post false, misleading, or defamatory content.
8.3 Attempt to interfere with the Platform’s security, functionality, or operations.
9. Limitation of Liability
9.1 AiPay Mart is an intermediary platform and is not liable for disputes, damages, or claims arising from transactions between Buyers and Vendors.
9.2 To the maximum extent permitted by law, AiPay Mart disclaims all warranties, whether express or implied.
10. Indemnification
You agree to indemnify and hold AiPay Technology Private Limited harmless from any claims, damages, or liabilities arising from your use of the Platform or breach of these Terms.
11. Dispute Resolution
11.1 Any disputes shall first be attempted to be resolved amicably between the parties.
11.2 If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in India.
12. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data.
13. Amendments
We may revise these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform signifies acceptance of the updated Terms.
